Terms of Use

These Terms of Use (“Terms”) govern your use of the PupMiles iOS application and the website at pupmiles.com (together, the “Service”), provided by Busted Pixel Media (“we,” “us,” or “our”).

By downloading, installing, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Who can use PupMiles

You must be at least 13 years old to use PupMiles. If you are under the age of majority in your jurisdiction, you may use PupMiles only with the consent and supervision of a parent or legal guardian who agrees to be bound by these Terms on your behalf.

2. Your Apple ID and account

PupMiles does not maintain its own user accounts. Your access to the app and to Premium features is tied to the Apple ID you use to download the app and purchase any subscription. You are responsible for the security of your Apple ID and for activity that occurs through it.

3. Subscriptions and payment

PupMiles offers a free version and an optional auto-renewing Premium subscription (monthly and annual plans). Subscriptions are billed through your Apple ID by Apple, not by Busted Pixel Media. The current price, billing interval, and trial terms (if any) are shown in the app before you confirm the purchase.

• Payment is charged to your Apple ID at confirmation of purchase.
• Subscriptions automatically renew at the then-current price unless auto-renew is turned off at least 24 hours before the end of the current period.
• You can manage and cancel your subscription in Settings → Apple ID → Subscriptions.
• Canceling stops future renewals. You retain Premium access until the end of the current paid period.
• Refunds are handled by Apple per the Apple Media Services Terms.

Prices are shown in U.S. Dollars by default and may vary in other regions. We may change subscription prices from time to time; price changes will not affect the current paid period and will be disclosed before they take effect on renewal.

4. License to use the app

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to install and use PupMiles on a device that you own or control, solely for your personal, non-commercial use. This license is also subject to Apple’s standard End User License Agreement (“Apple EULA”).

5. Acceptable use

You agree not to:

• Use the Service in any way that violates applicable law.
• Interfere with, disrupt, or attempt to gain unauthorized access to the Service, our systems, or the accounts or devices of other users.
• Reverse engineer, decompile, or attempt to derive source code from the app, except to the extent that applicable law expressly permits such activity.
• Use the Service in a way that endangers your safety, your pets’ safety, or the safety of others — including interacting with the app while operating a vehicle, crossing a street, or in any situation that requires your full attention.

6. Not medical or training advice

PupMiles is a fitness and routine tracking app. It is not a veterinary product, diagnostic tool, or training program. Walk distance, pace, and streak data are provided for your own reference and should not be treated as medical advice. If your pet shows signs of illness, injury, or distress, consult a licensed veterinarian. For behavioral or training questions, consult a qualified trainer.

7. Your content

You retain ownership of content you add to PupMiles — pup names, photos, notes, walks, and routines. This content is stored in your device and in your personal iCloud container; we do not claim ownership of it.

If you voluntarily send us feedback, suggestions, or ideas, you grant us a perpetual, irrevocable, worldwide, royalty-free license to use that feedback to improve the Service, without obligation to you.

8. Our intellectual property

The PupMiles name, logo, marketing site, and the design and code of the app are owned by Busted Pixel Media and protected by copyright, trademark, and other laws. Except for the license granted in Section 4, these Terms do not grant you any rights in our intellectual property.

9. Availability and changes

We work hard to keep PupMiles reliable, but we do not promise that the Service will be uninterrupted, error-free, or available in every region or on every device. We may modify, suspend, or discontinue parts of the Service at any time. Where we retire a Premium feature, we will communicate the change in advance and, where applicable, offer reasonable alternatives.

10. Termination

You can stop using PupMiles at any time by deleting the app and canceling your subscription. We may suspend or terminate your access if you materially breach these Terms or if we are required to by law. If your subscription is terminated for breach, refunds are not guaranteed.

11. Disclaimers

The Service is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, Busted Pixel Media disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that walk metrics will be accurate in every environment or that the Service will meet every requirement you may have.

12. Limitation of liability

To the fullest extent permitted by law, Busted Pixel Media will not be liable for any indirect, incidental, consequential, special, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or in connection with the Service. Our total liability for any claim arising out of or relating to the Service is limited to the greater of (a) the amount you paid us for the Service in the twelve months before the claim, or (b) USD $25.

Some jurisdictions do not allow the exclusion or limitation of certain damages. In those jurisdictions, the limitations above apply only to the maximum extent permitted by law.

13. Apple-specific terms

PupMiles is distributed through the App Store. You acknowledge that these Terms are between you and Busted Pixel Media, not Apple, and that Apple is not responsible for the Service or its content. Apple has no obligation to furnish maintenance or support for PupMiles. To the maximum extent permitted by applicable law, Apple has no warranty obligation with respect to PupMiles. Apple and Apple’s subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

14. Governing law and disputes

These Terms are governed by the laws of the State of Florida, United States, without regard to its conflict-of-law rules. You and Busted Pixel Media agree to the exclusive jurisdiction of the state and federal courts located in Florida for any dispute not subject to arbitration, except where prohibited by applicable consumer protection law.

15. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will update the “Last updated” date and, where appropriate, notify you in the app. Your continued use of the Service after an update means you accept the revised Terms.
